Abstract:The Tranditional Chinese medicine preparation produced by medicalinstitutions is an important carrier of Chinese medicine knowledge，which can meet the differents clinical patients demands. However，the current intellectual property system has not yet provided comprehensive protection for Chinese medicine preparations. Therefore，it has affected the development of Chinese medicine to a certain extent. This paper combines the characteristics of Chinese medicine preparations in medical institutions，and to explore the relevant systems to promote the development and production of traditional Chinese medicine preparations in medical institutionswhich are able to obtain patent authorization and combined with the Law of the PRC against Unfair Competition，and incorporating the medical preparations into the Chinese medicine protection varieties and the feasibility analysis of the management of the Trademark Law，etc.，with a view to improving the intellectual property protection system for Chinese medicine preparations in medical institutions.
